Rules for the “Celebrate Dog Day with the Noteć Valley” Event
  • §1 Preliminary Provisions
  1. The event is organized by DNP sp.featuring.o.with its registered office in Polanowo, address: 89-300 Wyrzysk, Polanowo 27A, entered in the Register of Entrepreneurs by the District Court for Poznań – Nowe Miasto and Wilda in Poznań, 9th Commercial Division of the National Court Register – National Court Register under KRS number: 0000856761, with tax identification number (NIP) 7642679020, with share capital of PLN 3,326,600.00 paid in full.hereinafter referred to as “the Organizer” or “Noteci Valley”.
  2. These Rules and Regulations, hereinafter referred to as the “Rules and Regulations,” set forth the terms and conditions for participation in the event titled “Celebrate Dog Day with the Noteć Valley” (hereinafter referred to as the “Event”).
  3. The Organizer hereby declares that the Event is not a game of chance, a raffle, a betting game, a promotional lottery, a game in which the outcome depends on chance, or any other form provided for in the Act of November 19, 2009.on gambling (Official Journal).U.from 2016., pos.471).
  4. The contest is being run by the Organizer online via its Facebook page – https://www.facebook.com/valley-of-the-night-food.The Contest is being held in the Republic of Poland from July 1, 2022, to July 8, 2022. Participation in the Contest requires acceptance of these Rules by commenting “I accept the Contest Rules” under the note containing them or under the contest post.
  5. The organizer is responsible for awarding the prizes provided for in the Contest.
  6. The Contest is conducted via the Facebook social media platform, with the proviso that the Contest is in no way sponsored, endorsed, or administered by Facebook, nor is it associated with Facebook.
  • §2 Persons Eligible to Participate in the Game
  1. Subject to the provisions of paragraph 2, participants in the Contest (hereinafter referred to as “Participant” or “Participants,” as applicable) may only be adults who meet the following criteria: a) acting as a consumer within the meaning of Art..Section 221 of the Civil Code; b) who are residents of the Republic of Poland.
  2. Employees of the Organizer and their immediate family members are not eligible to participate in the Contest.The term “immediate family members” refers to: ascendants (parents, grandparents), descendants (children, grandchildren), siblings, spouses, the parents and children of spouses, and persons related to them by adoption.If the above-mentioned party wins.the person to whom the award specified in § 3(1) is granted.2. below, the Organizer is entitled to claim a refund of the prize.
  • §3 Rules for Participating in the Game
  1. The task for participants in the Contest is to post a comment under the contest post published on July 1, 2022 (no restrictions) a photo or video that best captures the theme: show what you love most about your dog.
  2. From among the comments posted under the tagged contest post, the authors of three entries will be selected to receive a prize from the Noteć Valley, as specified in detail in § 5, para..1. Rules and Regulations.
  3. Anyone who leaves a comment — that meets the Contest’s terms and conditions — to the post marked as a contest on the profile https://www.facebook.com/dolinanotecikarma and leaves a comment saying “I accept the Contest Rules” under the post containing the Contest Rules or under the contest post has a chance to win a prize.No additional registration is required to participate in the event.
  4. By posting a response in the comments that meets the Contest’s terms and conditions, you simultaneously agree to transfer the copyright to the Contest organizer without additional compensation and consent to the use of this material in all forms of exploitation in accordance with the provisions of § 9 of the Rules and Regulations.
  5. The material referred to in paragraph.1. The entry must be the result of the Participant’s own creative work and must not infringe upon the rights of third parties, including, in particular: personal rights, copyrights, and the right to protection of one’s image.
  6. The Participant declares that: a) The Material does not in any way infringe upon the rights or personal rights of third parties, nor does it infringe upon any copyrights, b) has not transferred the economic copyrights to the material to a third party nor granted any exclusive license authorizing the use of the comment, c) they have the exclusive right to grant permissions for the disposal and use of adaptations of the material, d) they bear full liability to the Organizer for any untruthfulness in the above.statements, e) agrees to indemnify the Organizer against any liability in the event that third parties assert claims, including through legal proceedings, arising from a violation of their rights with respect to the material referred to in paragraph.1 above.
  7. A person who has submitted an Entry in accordance with the Rules and meets the conditions set forth in the Rules becomes a Contest Participant.
  8. A participant may submit an unlimited number of entries to the Contest.
  • §4 Rules for Selecting the Contest Winner
  1. From among all valid entries the jury will select: 3 posted under the contest post that best explore the theme.
  2. The jury selects the winners at its discretion, based on the following criteria: uniqueness, originality, and the interesting nature of the material referred to in § 3, para..1. Rules and Regulations.
  3. The winner will receive the prize specified in detail in § 5, point 1 of the Rules and Regulations.The winners will be announced no later than15.07.2022.
  4. Each participant may receive only one prize, regardless of the number of entries submitted.
  5. The results of the contest will be posted on the https://www profile.facebook.com/valley-of-the-night-food.Prior to publication, the Organizer will contact the Winner via a private message on Facebook to obtain the Winner’s consent to disclose their first and last name or username by having the Winner submit a statement with the following text: “I agree to DNP sharing sp.featuring.o.with its registered office in Polanowo, address: 89-300 Wyrzysk, Polanowo 27A, on the DNP Facebook page, my personal data, specifically my first and last name or username, for the purpose of providing information about the results of the Contest in which I am participating.At the same time, I acknowledge that I have the right to withdraw my consent at any time..
  • §5 Awards
  1. The prize in the contest is a set of food and accessories from the brand Dolina Noteci:
    • Dog treat box: 1 piece.Superfood Kangaroo and Beef, 400 g, 1 pack.Superfood Venison and Beef 400 g, 1 pack.Superfood Venison and Duck 400 g, 1 pack.Superfood Duck and Quail 400 g, 1 pack.Superfood Lamb and Veal, 400 g, 1 pack.Superfood Beef and Goose Hearts 400 g, bowl mat, lid, spoon, DN Green bags, stickers.
    • Cat treat box: 1 pc.Dolina Noteci Superfood Trout and Tuna, 85 g pouch, 1 piece.Dolina Noteci Superfood Venison and Beef, 85 g pouch, 1 piece.Dolina Noteci Superfood Veal with Lobster and Shrimp, 85 g pouch, 1 piece.Dolina Noteci Superfood Chicken and Beef with Cod, 85 g pouch, 2-pack.Dolina Noteci Superfood Lamb and Veal Pouches, 85 g, 2-pack.Dolina Noteci Superfood Duck & Beef Pouch (85 g), Bowl Mat, Spoon, Stickers.
  2. The winner is not entitled to exchange the Prizes for cash or prizes of any other kind.
  3. The right to the Prize is not transferable to third parties.
  4. Prizes will be awarded in accordance with applicable tax laws, meaning that the Organizer, as the withholding agent, will deduct a flat-rate personal income tax of 10% of the Prize’s value, without charging the Winner.
  • §6 Awarding of Prizes
  1. The Organizer agrees to deliver the Prize to the Contest Winner within 30 business days of receiving the complete shipping information.
  2. In order to present the Prize, the Winner will be asked by the Organizer to provide their first and last name, contact phone number, and mailing address within the territory of the Republic of Poland (city, ZIP code, street, house number, apartment number).
  3. If the Participant fails to provide all the information required by these Rules and Regulations, as specified in § 6(2), via email or a private message on Facebook, or if such information is provided after the deadline set by the Organizer, pursuant to § 6(1), the Participant loses the right to the Prize, which remains the property of the Organizer.
  4. The recipient's address will be used solely for the purpose of delivering the prizes.
  • §7 Processing of Personal Data
  1. Participants’ personal data will be processed to the extent and for the purposes necessary to conduct the Contest, and in particular to communicate with Participants, award Prizes to Winners, and handle complaints.
  2. The Organizer of the Event is the Personal Data Controller.The Data Protection Officer appointed by the Organizer is Monika Zygmunt-Jakuć (mailing address: 28 Czerwca 1956 St..406 units.15, 61-441 Poznań, email: IDO@dolina-noteci.en.Personal data will be processed for the purpose of organizing the contest pursuant to Article.Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR).
  3. Participants’ personal data will be disclosed only to entities authorized by law and to entities providing support to the Organizer on a contractual basis and in accordance with the data processing agreements entered into (e.g., the company that will deliver prizes to the Winners).Personal data will be processed until the statute of limitations on claims expires, and in the case of Winners, until their tax obligations have been fulfilled.
  4. Each Participant has the right to access their personal data, the right to rectify, erase, or restrict the processing of such data, the right to data portability, the right to object, including the right to withdraw consent at any time without affecting the lawfulness of processing carried out on the basis of consent prior to its withdrawal.The data subject has the right to lodge a complaint with the President of the Personal Data Protection Office if they believe that the processing of their personal data violates the provisions of the General Data Protection Regulation of April 27, 2016.Providing this information is voluntary, but necessary to achieve the above purpose.
  5. The Winner’s personal data, including: first and last name or Facebook username may be made available to other users of the Facebook social network in connection with the Organizer posting information about the results of the Contest on its profile on that site, provided the Participant has given separate consent in accordance with § 4, point.Section 5 of these rules and regulations.
  6. The personal data of contest participants will be retained for the period necessary to achieve the purposes set forth in the Rules and Regulations.
  7. The organizer implements technical and organizational measures designed to ensure that the personal data entrusted to it is protected by security measures that are appropriate to the risks and the category of data being protected.The organizer shall, in particular, take into account the risks associated with data processing arising from:
    (a) accidental or unlawful destruction,
    (b) loss, alteration, or unauthorized disclosure of data,
    (c) unauthorized access to personal data that is transmitted, stored, or otherwise processed.
  • §8 Complaint Procedure
  1. Any complaints or objections regarding the conduct of the Contest must be submitted, along with a justification, via email to: karma@dolina-noteci.en.Please include the following in the subject line: “Celebrate Dog Day with the Noteć Valley”.
  2. Complaints submitted in violation of paragraph 1 will not be considered.
  3. Complaints submitted will be reviewed by the Organizer without delay, but no later than within 7 (seven) business days from the date of receipt of the complaint.When reviewing complaints, the Organizer relies on the provisions of the Terms and Conditions and applicable laws.
  4. Individuals who have filed complaints in accordance with the applicable Terms and Conditions will be notified by the Organizer of the outcome of their complaint via email no later than within 7 (seven) business days from the date the complaint was reviewed.
  • §9 Copyright
  1. 1.Upon the awarding of the Prize in the Contest, the Participant transfers to the Organizer all economic copyrights to the comment referred to in § 3, para..1 of the Terms and Conditions (hereinafter also referred to as the “Work”) pursuant to Art..Section 921(3) of the Civil Code, without any time or territorial restrictions, in the following fields of exploitation:
    (a) recording on any audiovisual or audio medium, including, in particular: video media, photographic film, magnetic tape, computer disks, and all types of media intended for digital recording,
    (b) reproduction by any means, including: magnetic reproduction on videotapes and audiovisual discs, photomechanical and digital reproduction, computer recording on all types of media suitable for this form of recording; the production of copies of works using specific techniques, including printing, reprography, magnetic recording, and digital techniques,
    (c) the distribution of the original or copies on which the Work is fixed—the distribution of reproduced media domestically and abroad, and the lending of the original or copies,
    (d) distributing the Work in a manner other than that specified in subparagraphs (1) through (2) – public performances, exhibitions, screenings, as well as making the Work publicly available in such a way that anyone may have access to it at a place and time of their choosing, including, in particular, making it available on websites,
    e) uploading an unlimited number of broadcasts and editions to computer memory and a multimedia network,
    f) use in multimedia works,
    (g) marketing via the Internet and other data transmission technologies that utilize telecommunications, information technology, and wireless networks,
    (h) the use of the Work and excerpts thereof for promotional and advertising purposes,
    (i) use for marketing purposes, including advertising, promotion, branding, products and services, and other business activities.
  2. The Participant authorizes the Organizer to exercise derivative rights to the Work, to the extent justified by the use of the Work in the aforementioned fields of exploitation, including the right to modify the Work, combining it with other works, and transferring it to other entities for modification.
  3. The Participant agrees not to exercise moral rights with respect to the Work.
  • §10 Final Provisions
  1. The text of the Terms and Conditions is available at the Organizer’s office and on the website: www.more than food.at pl and on the https://www page.facebook.com/dolinanotecikarma/.
  2. Failure to comply with the terms and conditions set forth in the Rules may result in the Participant’s exclusion from the Contest and the forfeiture of their right to the Prize
  3. In matters not covered by these Terms and Conditions, the generally applicable provisions of law shall apply, in particular the provisions of the Civil Code and the Act on Copyright and Related Rights (Journal of Laws.U.2017 item.(880) the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016.on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and the Act on the Protection of Personal Data (Journal of Laws.U.from 2016., pos.922, as amended.).
